This Privacy Policy governs your experience trading with our business (the “Business”) and on this Website (and any associated webpages, including use of any of our services through a mobile device, mobile application or otherwise) (the "Website") unless otherwise indicated.

In this Privacy Policy, the following defined terms apply: 

  • Act means the Privacy Act 2020 (as amended or replaced from time to time). 
  • Actionmail Limited (trading as ActionHQ), (including any of its subsidiaries or corporate affiliates, collectively, "ActionHQ," "we" or "us"). 
  • Personal information means information about an identifiable individual. 
  • Web Services means any of our websites, customer portals, mobile applications, and electronic media from time to time. 

 

COLLECTION OF PERSONAL INFORMATION 

What Types of Personal Information Do We Collect? 

The personal information we collect will vary depending on the services that you use and your interactions with us. For example, we may collect the following types of personal information: 

Basic identification and contact information including name, gender, age, date of birth, address, email address, and telephone number(s). 

Other information that may personally identify you such as profession, hobbies, interests, and other preferences for marketing purposes and particularly if you enter a competition or promotion. 

Other financial and credit information including information relating to your credit history if we assist you in applying for finance or credit. 

Information that you allow to be shared with us and that is part of your public profile on any social media network including information you share with us by posting on our social networks. 

Information that you provide to us or is otherwise publicly available, including, without limitation, your enquiries to us and our responses to them, contact with our customer representatives, promotions, customer surveys, feedback, and other communications, details of the products and services you have enquired about or purchased from or through us and any additional information necessary to deliver those products and services.  

Any additional information relating to you that you provide to us using our Web Services. 

Any membership information provided to us relating to any third-party membership program or loyalty schemes such as, without limitation. 

How Do We Collect Personal Information? 

Generally, we collect personal information from you directly. Information we collect from or about you may vary depending on how you use the Website, your engagement with our Business, and information you may choose to provide to us and to other sources. We may also collect your personal information from a third party if you have authorized them to provide, or authorized us to collect, that information 

Examples of ways in which we may collect such information from you include the following: 

Registration and Ordering: Before using certain parts of this Website or ordering products or services, you must complete a registration form and/or create an account. This will require you to provide certain personal and billing information. 

If you create an account using your login from a third-party service, like Facebook or Twitter, we will access and collect the information that your privacy settings on that third-party service permits us to access so that we can create your account for you.  

Business sale transactions: When you make a purchase from our business, we will collect your billing information you provide to us for the transaction, as well as your purchase information. We may also ask you to provide certain personal information if you are interested in receiving information about upcoming sales, events, and other promotions. 

Marketing Emails: We may send marketing and or promotional emails to the email address you provide to us. You may unsubscribe at any time from receiving these marketing messages by clicking on the "Unsubscribe" link contained in any promotional email or contact us at security.privacy@actionhq.co (and put "Unsubscribe" or "Opt Out" in the subject line). (Please note that despite unsubscribing from such marketing communications, we may still contact you in relation to your order(s) or any issues relating to any business you conduct with us.) 

Live Support: If you choose to contact us via Live Chat on the Website, we collect your name and e-mail address and any other information you choose to provide to us to help better serve you. Please note that we store all chat information and transcripts for a period, as determined by ActionHQ. These transcripts are only accessed by ActionHQ for training and customer service purposes. 

Written Reviews: ActionHQ will require a valid registered e-mail address and a review name when it comes to completing the review form on the Website in relation to testimonials or feedback. Following the moderation process, your review, alongside your review name and date, may be posted on the Website. 

Automatic Collection 

We may use cookies, web beacons, pixel tags or other technologies to automatically collect certain information when you use our Website or interact with our emails on or from our Website or other Websites. This information may include your IP address, browser type, geolocation data, unique user ID, cell phone model, operating system and carrier, and Internet Service Provider. We also may collect information about your use of our services, such as the number of times you return or visit the Website, whether you click-through, open, or forward links, emails, and ads, the URLs and webpages you've visited, sections of or content on pages of the Website on which you click or in which you are interested, the number of times you visit each webpage, what downloads and/or search queries you have made, how long you spent on particular sections of the Website and on the Website generally, and other Website usage data. You may adjust your browser settings to limit certain tracking or to decline cookies, but by doing so, you may not be able to use certain features on the Site or take full advantage of our offerings. We also use cookies to collect information around abandoned shopping carts. Once the cart is abandoned, an SMS message and/or email may be sent as a reminder. 

Online Behavioural Advertising 

We may partner with third party ad network(s) to either display advertising on our Website or to manage our advertising on other Websites. Our ad network partner(s) may use cookies, heat maps and/or web beacons to collect non-personally identifiable information about your activities on our Website and other Websites to provide you with targeted advertising based upon your interests and to help us better understand how users are engaging with content on our Website. Our system may not respond to Do Not Track requests or headers from some or all browsers. 

Information Collected from Other Sources 

We may obtain information about you from other sources, including commercially available sources, such as social networks, data aggregators and cooperatives and public databases. This information may include name, demographic information, interests, and publicly observed data, such as from social media and shopping behaviour. We may combine the information we receive from and about you, including the information you provide to us, information we receive from third parties, information we automatically collect (as explained above) and information provided or collected offline including when you trade with our Business. 

What Happens if We Are Not Able to Collect Personal Information? 

You are not required to provide us with any personal information that we request. However, if you do not do so, or restrict our ability to collect, use, hold, and disclose your personal information, then: 

We may not be able to provide you with the products, services, or assistance you want or to the standard that we otherwise could have. We may not be able to respond to your enquiries as effectively as we otherwise would have. 

 

USE OF PERSONAL INFORMATION 

We may use your personal information for purposes you provided it to us for. For example:

By using our Web Services or providing us with your personal information, you consent to receiving promotional or marketing communications by electronic messages, phone call, SMS, or other communication methods from us and/or third parties on our behalf about products and services offered by us or selected third parties. 

You may opt-out of receiving those electronic messages or other communications by contacting us (see the ‘Contact us’ section below) or by utilizing any unsubscribe facility that accompanies an electronic message or other communication. If you withdraw your consent to receiving these electronic messages or communications or otherwise unsubscribe, you will no longer receive these types of electronic messages or communications from us within a reasonable period of us receiving your unsubscribe request. 

 

DISCLOSURE OF PERSONAL INFORMATION 

  • We may share personal information with the following organizations or people (for the purposes outlined above): Our trusted existing marketing agencies, advertisers, and partners.  
  •  Media agency, to send email and other communications, including interest-based advertising to you on our behalf.  
  • With companies that provide support services to us, such as a printer, mailing house, fulfilment company, credit card processor, email service provider or web host, amongst others.  
  • Publicly disclose the name, city, and state of the winner of any sweepstakes and contests in order to comply with legal requests and processes.,  
  • In the unlikely event that our company or substantially all our assets are acquired by a third party, such information may be one of the transferred assets. Should such a sale or transfer occur, we will require that the transferee use personal information provided through the Services in a manner that is consistent with this Privacy Policy. 
  • Use your written and/or video reviews on our Website, in Business and/or within ActionHQ for product improvement, product development, customer experience improvement, and possible communication/PR purposes. 
  • Credit assessment, credit reporting, and debt collection agencies. 

 

STORAGE OF PERSONAL INFORMATION 

Storage 

Any personal information we hold will be securely held at our office or on our behalf. For example, some information will be stored in “the cloud” in secure databases on our behalf by third parties based overseas. The use of these services will not relieve us of our obligations and the Privacy Act or this policy., ActionHQ has implemented certain physical, administrative, and technical security measures to protect against the loss, misuse, or alteration of the information you provide. 

Security 

The security of your personal information is very important to us. We will take reasonable technical and organizational precautions to protect personal information that we hold. However, due to the inherent nature of the internet, we are not able to guarantee the security of any personal information that we hold or that you transmit to us. 

When using the Website, you should ensure that there is no unauthorized access to your account information by limiting access to your computer (or other device) and browser by signing off after you have finished accessing your account. 

Updates 

We rely on you to update us if your contact details change. 

How Long Do We Retain Your Personal Information For? 

We keep your personal information for as long as it is required, having regard to the purpose for which the personal information was collected and as otherwise permitted or required to comply with the law. 

When the personal information is no longer required for the purpose, it was collected or is not required or permitted to be retained by law, then we will destroy or anonymize it 

As a business practise ActionHQ retains email addresses, phone numbers and postal addresses for 7 years from the last purchase or other interaction with ActionHQ by a customer because it believes that such retention period allows it to provide the optimal trading experience for its repeat customers. All other personal information that is collected by ActionHQ is retained for five years from the last purchase or other interaction with ActionHQ by a customer because such personal information is less important to the trading experience. 

 

ACCESS AND CORRECTION OF YOUR PERSONAL INFORMATION 

Under the Act, you have the right to access and request correction of any personal information that we hold about you. You are welcome to contact us at any time. In some cases, there may be a charge for retrieving and providing a copy of the personal information to you, correcting information based on your request, or attaching to any personal information a statement of any correction sought but not made. On occasion, we may also insist on the payment of the charge in advance before responding to a request for which we can charge. 

Notwithstanding the above, we may not grant you access where we cannot reliably verify your identity first, it would breach somebody else’s right to privacy, or would endanger someone else’s safety. If we refuse you access to your personal information, we will provide you with an explanation for that refusal. The Act sets out reasons we may withhold information from you. 

If you believe the personal information is incorrect, incomplete, or inaccurate, then you may request that we amend it. If we do not agree that the information is incorrect, then we will make a note of what your views are as to the correct personal information and attach this as appropriate. 

You can (a) access, correct, or update your Personal Information, and/or (b) disable your online account to prevent any future purchases through that account. You can make these requests by emailing your request to ActionHQ Privacy Officer at security.privacy@actionhq.co. Please clearly label the subject line "Corrections / Disabling Account," and do not email your credit-card number or other sensitive information. In specific circumstances, proof of identity and payment may be required. 

If you would like to unsubscribe from receiving marketing or promotional emails from us, please click on the "Unsubscribe" link contained in any promotional email or contact us at security.privacy@actionhq.co (and put "Unsubscribe" or "Opt Out" in the subject line). 

Children's Privacy 

We do not intentionally collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen you should not register, order, purchase or provide information to or from ActionHQ. If you have knowledge that a child under the age of thirteen has submitted Personal Information to us, please email us at security.privacy@actionhq.co, and we will remove that child's personal information from our files. 

 

Updates to this Privacy Policy 

We may update this privacy policy at any time by posting an updated version on our Web Services. The updated version will take effect immediately upon publication and will apply to all personal information that we hold about you. If the changes are material, we may also notify you directly, as required by law.
